AI Transparency Notice

EU AI Act — implementation status (March 2026): Prohibited AI practices apply since 2 February 2025. General-purpose AI model obligations apply since 2 August 2025. Transparency obligations (Article 50) and high-risk AI rules apply from 2 August 2026. A Digital Omnibus amendment (COM(2025) 836) proposed in November 2025 may further adjust timelines — we will update this notice when that proposal is adopted.

1. AI system classification

TagMyStock is an AI system that generates and manipulates digital content (images, metadata, and audio). Under the EU AI Act, our tools fall within the limited-risk category, subject to transparency obligations under Article 50, which become enforceable on 2 August 2026.

TagMyStock is not classified as a high-risk AI system (Annex III). It does not make autonomous decisions affecting individuals' rights, safety, or access to essential services. TagMyStock is also not a general-purpose AI (GPAI) model provider — we are a deployer that routes requests to third-party GPAI model providers (FAL.ai, OpenRouter).

2. What AI does in TagMyStock

All content produced by TagMyStock is generated or modified by artificial intelligence. Specifically:

  • Create — generates images from text descriptions using AI diffusion models
  • Edit — modifies existing images based on text instructions using AI vision-language models
  • Upscale — enhances image resolution using AI super-resolution models
  • Cutout — removes image backgrounds using AI segmentation models
  • Metadata — generates titles, descriptions, and keywords using Anthropic Claude language models
  • Compose — generates audio tracks from text descriptions using AI music generation models

3. AI providers and models

TagMyStock routes requests to third-party AI model providers. We do not train or host our own models. These providers are subject to their own GPAI model obligations under Chapter V of the EU AI Act (applicable since 2 August 2025). Current providers:

  • FAL.ai — hosts image generation, upscaling, background removal, and audio generation models
  • OpenRouter — routes requests to vision-language models for image editing
  • Anthropic — provides Claude language models for metadata generation (titles, descriptions, keywords)

The specific model used for each operation is shown in the tool interface before and after processing. Models may be updated or replaced; we will reflect changes here.

4. AI-generated content disclosure

In anticipation of the Article 50 transparency obligations effective 2 August 2026, we already disclose the following:

  • All images created via the Create tool are entirely AI-generated and are not photographs or human-made artwork
  • Images processed via Edit, Upscale, and Cutout tools are AI-modified versions of the input you provide
  • Metadata (titles, descriptions, keywords) is AI-generated and may require human review for accuracy
  • Audio tracks produced via Compose are entirely AI-generated synthetic audio

Gallery items display the AI model used for creation. When you download or distribute AI-generated content, you are responsible for disclosing its AI origin where required by applicable law.

5. Prohibited practices compliance

The EU AI Act's prohibited AI practices (Article 5) have applied since 2 February 2025. TagMyStock does not deploy any prohibited AI practices. Specifically, TagMyStock does not:

  • Use subliminal or manipulative techniques to influence user behaviour against their interests
  • Exploit vulnerabilities of specific groups
  • Perform real-time remote biometric identification in public spaces
  • Build social scoring systems
  • Infer emotions in workplaces or educational settings

6. Data processing for AI operations

When you use a TagMyStock tool:

  • Your inputs (prompts, images) are transmitted to the relevant AI provider for processing
  • AI providers process inputs in real time and return results — they do not retain your data for model training
  • Generated outputs are stored in your gallery on CDN infrastructure
  • Usage logs are retained for credit accounting and service reliability; they do not contain the content of your prompts or images

7. Limitations and risks

AI-generated content may:

  • Contain inaccuracies, artifacts, or unintended visual elements
  • Reflect biases present in the training data of underlying models
  • Produce metadata that is not perfectly accurate for a given image
  • Generate content that inadvertently resembles existing copyrighted works

TagMyStock applies content moderation (safety filters) to generated images but cannot guarantee all outputs will be appropriate for every use case. You are responsible for reviewing AI-generated content before publishing or distributing it.

8. Human oversight

TagMyStock is designed as a human-in-the-loop tool. No content is published or distributed automatically — you review every result and decide whether to download, keep, or discard it. You retain full control over:

  • What prompts and images to submit
  • Which AI model to use
  • Whether to accept, modify, or discard results
  • Whether to make gallery items public
  • What content to download and distribute

9. Your rights

Under the EU AI Act and related regulations, you have the right to:

  • Be informed that you are interacting with an AI system (this notice fulfils that obligation)
  • Know when content has been AI-generated or AI-modified
  • Access, correct, or delete your personal data — see our Privacy Policy
  • Lodge a complaint with your national AI supervisory authority or data protection authority
